State registration of R&D

State registration of RTD projects in the Republic of Belarus

According to the Decree of the President of the Republic of Belarus of 25 May 2006 N 356 “About the state registration of research, technology and development projects” (in the version of the Decree of the President of the Republic of Belarus of 22 June 2009 N 328) Belarusian Institute of System Analysis and Information Support of Scientific and Technical Sphere (BelISA) is entrusted with registering the research, technology and development projects (RTD projects) and maintaining a State Register of RTD projects.
 
To be registered, RTD projects should be important for realization of the priorities of the national economy and social sphere, developing new technologies and science-based competitive production, and also creating the prospective scientific directions.
 
According to the Law “About the VAT” (p.4 Article 2) the budget of RTD projects registered in the State Register is exempted from taxation in the order defined by the President of Belarus whether these projects are carried out on the territory of the Republic of Belarus.
 
The order of the state registration of RTD projects is defined by the Rule on the order of the state registration of research, technology and development projects (further – the Rule) approved by the Decree of the President of the Republic of Belarus of 25 May 2006 N 356 “About the state registration of research, technology and development projects” (in the version of the Decree of the President of the Republic of Belarus of 22 June 2009 N 328).
 
The state registration is carried out upon the results of evaluation in concordance with the order defined by the Council of Ministers of the Republic of Belarus. The evaluation decides whether the RTD project corresponds to the requirements mentioned in the part 1, p. 2 of the Rule.
 
Republican bodies of state management, other state organizations subordinated to the Government of the Republic of Belarus, and also the National Academy of Sciences carry out evaluation of the projects implemented by organizations and companies subordinated to them. The State Committee for Science and Technology evaluates the RTD projects implemented by organizations and companies which are not subordinated to the mentioned above state bodies, and also by individual entrepreneurs.
 
The RTD projects which have passed the state scientific & technical or the state scientific evaluation do not need to pass the evaluation described above.
 
To register a RTD project, an organization-executer should send to BelISA the following documents within 1 month after signing a contract for project implementation:
  • Registration card according to the special form approved by the State Committee for Science and Technology;
  • A copy of the contract for the project implementation (if any);
  • Technical (scientific) task or technical and economic substantiation of the project;
  • Action plan (calendar) for the project approved by the head of the organization-executer;
  • Registration data of the organization (at the first visit to BelISA or when some data have been changed (e.g., address, head of organization, etc);
  • For RTD projects which have passed the state scientific & technical or the state scientific evaluation – a copy of the protocol (extract from the protocol) of the state S&T expert council or inter-ministerial expert council.
If the project is carried out by several organizations each of them should present the documents listed above independently.
 
Documents which are not complete or presented in the way different from the one mentioned above will be returned to the organization-executer within 3 days from the date of arrival with explanation of the reasons. Within 20 days upon receiving the documents BelISA considers them and, if they correspond to criteria for RTD projects, carries out registration of those projects which have passed the state scientific & technical or the state scientific evaluation, or sends the documents to the state bodies and organizations for evaluation (whether the projects correspond criteria defined in the part 1, p. 2 of the Rule). While doing this, BelISA has a right to ask the organization-executer for additional information.
 
The project is considered to be registered on the date when BelISA makes a decision about its inclusion in the State Register.
 
If BelISA decides that the RTD project is not in line with the criteria for RTD or the State Committee for Science and Technology considers that it doesn’t correspond with the criteria defined in the part 1, p. 2 of the Rule, BelISA within 10 days after receiving the documents or conclusion by the SCS&T makes a decision about inexpediency of including this project in the State Register and informs the organization-executer about the negative decision.
 
If the RTD project registered in the State Register is discontinued an organization-executer has to inform BelISA about this within 1 month after the stop date in written mentioning the registration number, title of the project, results achieved by the stop date, the reason of discontinuation. It should also enclose a copy of decision on discontinuation of the project (decision of the state body or other organization, agreement with a customer, an order or any other decision of the head of the organization-executer).
 
If the title of the project has been changed, the organization-executer has to present to BelISA the documents defined in p.4 of the Rule within 1 month after the date of changes. This project is included in the State Register under the new registration number while the previous number is cancelled. 
 
Upon finalizing or discontinuation of the RTD project registered in the State Register the organization-executer has to present to BelISA within 2 months from the date of approval of reports an information card according to the form approved by the State Committee for Science and Technology. The following documents duly signed by the head of the organization-executer have to be enclosed to the information card:
  • Report on the project;
  • Explanation notes or technical report (if it’s foreseen in the technical task);
  • Advertising & technical description of the S&T products according to the form approved by the State Committee for Science and Technology.
Upon receiving the information card and enclosed documents, BelISA within 20 days introduces the appropriate data in the State Register and gives a certificate about inclusion of the data presented in the information card into the State Register.
 
If the organization-executer hasn’t presented the reporting documents within 2 months after the end of the project, BelISA sends a reminding letter. If the reporting documents are not presented within 1 month since the date of mailing, the project is excluded from the State Register. BelISA informs the organization-executer and organization to which it is subordinated about exclusion in written. It also informs fiscal bodies according to the location of the organization-executer.
